No Purchase Necessary (AMOE)

Also known as AMOE, Alternative Method of Entry, NPN, Free Entry

By Reviewed Editorial policy

In short

AMOE stands for Alternative Method of Entry. The free route into a sweepstakes, usually by post. Its existence removes the consideration element that would otherwise make the activity gambling.

“No purchase necessary” is the phrase that appears on every legitimate sweepstakes, from a soft drink promotion to a sweepstakes casino. It is a legal requirement, not marketing.

Why it exists

US gambling law generally requires three elements: consideration, chance and prize. A promotion with all three is a lottery, which private companies mostly cannot run.

Remove consideration, make entry free, and the same promotion is a lawful sweepstakes.

The AMOE is how consideration is removed. As long as a genuinely free entry route exists and is disclosed, purchasers are deemed not to have paid for their entry.

What the route must be

Courts and regulators have generally required the free route to be genuinely equivalent, the same odds, the same prizes, no meaningful disadvantage.

In practice, for sweepstakes casinos, this means a postal request with conditions set out in the official rules:

  • Handwritten: this is near-universal, and it exists specifically to prevent automated bulk entry
  • Specified wording including your name, address and account identifier
  • A hand-addressed stamped envelope, often of stated dimensions
  • Limits per envelope, per day, or per household
  • A postal address that is genuinely monitored

Typical yield is 1 to 5 Sweeps Coins per valid request.

The tension in the model

The AMOE must be real for the structure to hold. It must also be inconvenient enough that it does not undermine the business.

Operators resolve this by making it available, disclosed and tedious. The result is a route that satisfies the legal requirement while being used by a negligible fraction of players, which is precisely the feature critics point to when arguing the model is gambling in substance.

Checking it

The presence and specificity of the AMOE in an operator’s official rules is a reasonable proxy for how seriously they take compliance. A clearly stated postal address, explicit format requirements and defined limits suggest a considered structure.

An operator whose rules are vague about the free route, or who makes it practically impossible, is taking a position that may not survive scrutiny.

Common questions

What does AMOE mean?

Alternative Method of Entry, the free route into a sweepstakes. Its existence removes the consideration element that would otherwise make the activity gambling, which is why every legitimate sweepstakes carries the phrase.

Why must AMOE requests be handwritten?

To prevent automated bulk entry. Operators must offer the route for the legal structure to hold, and they make it tedious enough that it does not affect the business, which is the central tension in the model.
